Rechtliche Kontrolle

Regulierungsbehörde

§ 35. (1) Die Aufsicht des Bundes über den Österreichischen Rundfunk beschränkt sich auf eine Aufsicht nach Maßgabe dieses Bundesgesetzes, unbeschadet der Prüfung durch den Rechnungshof. Die Rechtsaufsicht obliegt der Regulierungsbehörde. Ferner entscheidet die Regulierungsbehörde über Einsprüche gemäß § 33 Abs. 6.

(2) Der Regulierungsbehörde obliegt auch die Rechtsaufsicht über die Tätigkeit der Tochtergesellschaften des Österreichischen Rundfunks im Hinblick auf die Einhaltung der Bestimmungen dieses Bundesgesetzes.

(3) Regulierungsbehörde im Sinne dieses Bundesgesetzes ist, soweit nicht Abweichendes bestimmt wird, die KommAustria.
