Bei Unterlassungsdelikten ist der Tatort dort anzunehmen, wo der Täter hätte handeln sollen; dieser Ort fällt dann, wenn solche Unterlassungen im Zusammenhang mit dem Betrieb eines Unternehmens erfolgen, im Zweifel mit dem Sitz des Unternehmens zusammen; (nur) dann, wenn die tatsächliche Leitung eines Unternehmens an einem anderen Ort als an dem im Firmenbuch eingetragenen Sitz des Unternehmens ausgeübt wird, hat dies zur Folge, dass dieser Ort als jener Ort anzusehen ist, an dem der Täter hätte handeln sollen (vgl. VwGH 27.12.2007, 2003/03/0260).
